Qualifying for the E2 Visa

The E2 Visa is available to qualified entrepreneurs who are citizens of certain treaty countries. The applicant must have substantial investment capital in a new commercial enterprise in the United States. The business must be established in a commercial enterprise that will benefit the U.S. economy. The business can be either a sole proprietorship, a partnership, or a corporation.

The U.S. E2 Visa Application Process

The E2 Visa application process begins with the filing of an E Visa application with the United States Embassy or Consulate in the country of origin. The applicant will need to submit the following with the application:

  1. Passport: Your current passport must have at least one blank page and be valid for at least 6 months. It must have been issued within the past 10 years.
  2. Visa Application: You must complete the DS-160 nonimmigrant visa application online. You will need to pay the application fee with a credit card.
  3. Medical Examination: You must undergo a medical exam by a physician designated by the embassy. This exam must be completed within the past 12 months.
  4. Police Certificate: You must submit a certificate of good conduct from your country of origin. This document must be less than a year old and must be on the country's official letterhead.
  5. Financial Evidence: You must provide financial evidence that demonstrates your investment in the U.S. business. This can include bank statements, investment contracts, and letters of commitment from your business partners.

Once your application is reviewed and approved, you will be scheduled for an interview with a consular officer. You will need to appear in person for this meeting.

At this interview, the consular officer will review your application and will review your financial documents. The officer will assess whether your investment is substantial and will determine whether you have the intention of establishing a new business in the United States.

If you are approved, you will need to provide payment for your visa. The consular officer will then issue the E2 Visa and you can travel to the United States to establish your business.

Once you are in the United States, you will need to apply for an adjustment of status. This process will allow you to secure your legal permanent residency and will allow you to obtain a Green Card.
